QuikCAB Warranty Information
QuikCAB Limited Warranty
The Cabinet Guy- QuikDrawers LLC (“we,” “us,” or “our”) provides this limited warranty to the original owner or owners of the building where the QuikCAB cabinetry was first installed (the “Owner”). The products and components identified below are covered against defects in materials or workmanship that arise under normal use and proper care, subject to the terms of this warranty.
Coverage and Warranty Periods
Camden and/or Madison Cabinetry — Five-Year Limited Warranty
Camden and/or Madison cabinetry, excluding drawer slides and hinges (the “C/M Product”), is covered for five (5) years from the original purchase date. Coverage ends sooner if the Owner transfers the C/M Product to another person or entity. This is the “C/M Warranty,” and the earlier of those events ends its “C/M Warranty Period.”
Hamilton Cabinetry — One-Year Limited Warranty
Hamilton cabinetry, excluding drawer slides and hinges (the “H Product”), is covered for one (1) year from the original purchase date. Coverage ends sooner if the Owner transfers the H Product to another person or entity. This is the “H Warranty,” and the earlier of those events ends its “H Warranty Period.”
Drawer Slides and Hinges — Limited Lifetime Warranty
Drawer slides and hinges in Camden and/or Madison and Hamilton cabinetry (the “Hardware Product”) are covered for the Owner’s lifetime. Coverage ends sooner if the Owner transfers the Hardware Product to another person or entity. This is the “Hardware Warranty,” and the earlier of those events ends its “Hardware Warranty Period.”
The C/M Product, H Product, and Hardware Product are collectively the “Products.” The C/M Warranty, H Warranty, and Hardware Warranty are each a “Warranty” and collectively the “Warranties.” References below to the applicable “Warranty Period” mean the period stated above for the Product at issue.
Original Owner Only; No Transfer
Only the Owner is entitled to coverage. The Warranties do not transfer to a later owner or any other transferee of a Product.
Exclusions
The Warranties do not cover damage caused by normal wear and tear; transportation; storage; failure to follow instructions; alterations or modifications; unauthorized or improper repairs; accidents; abuse; misuse; improper handling or cleaning; outdoor use; installation that does not comply with our instructions, applicable building codes, or industry standards; or other acts or events beyond our control. Products stored or installed in environments with excessive moisture or extreme temperatures are not covered.
Stained and Unfinished Wood
Some covered Products are stained or unfinished, rather than painted, and are made from solid wood and wood veneers on plywood. Naturally occurring characteristics, including variations in color or grain, mineral streaks, and knots, are not defects. Cabinet color may change or soften because of the wood species, age, the character of the cabinets, ultraviolet light, sunlight, smoke, household cleaners, or other environmental conditions. A replacement Product or accessory may therefore differ in color, finish, or appearance from existing Products. Such variation or mismatch is not a covered defect.
Finishes Applied by Others
The Warranties do not cover changes to a Product resulting from stains, paints, sealers, or other finishes applied by anyone other than QuikCAB, or damage that occurs during that finishing process. The Owner is solely responsible for properly applying those finishes. A resulting difference between a replacement Product or accessory and the existing cabinets is not a covered defect.
Remedy for an Approved Claim
If a manufacturing defect is discovered during the applicable Warranty Period and a claim is approved under that Warranty, we will provide a comparable replacement for the defective Product or component at no charge for the replacement itself. The replacement will have a value equal to or greater than the original Product or component. Coverage is limited to replacement of the defective Product or component. It does not include service, labor, or transportation costs associated with removing or installing the defective or replacement Product or component.
The Warranties do not cover other products used or installed with a covered Product, including countertops, appliances, and plumbing fixtures. We will ship the replacement Product or component to the Owner by a shipping method we choose. Replacement is subject to the products then offered in the applicable cabinetry line. If the original Product or component is no longer available, we may provide a new product or component of the same or a similar style and/or appearance. We do not guarantee an exact finish or appearance match with the remaining cabinets or components.
A replacement supplied under an approved claim remains covered for the longer of the remainder of the original applicable Warranty Period or ninety (90) days.
How to Make a Claim
A claim must be submitted in writing during the applicable Warranty Period and must describe the alleged defect in detail. First contact the builder, dealer, distributor, or contractor who sold or installed the Product. If that party is unknown or you cannot obtain assistance, contact QuikCAB at (866) 937-7429 (EXT 2) or by email at Sales@QuikDrawers.com. A phone call alone does not satisfy the written-claim requirement.
You must provide enough evidence for us to evaluate the alleged defect, such as samples and/or a sufficient number of clear photographs, and a detailed receipt for the Product. If we request a sample of the defective Product, you must pay the shipping and handling cost to send it to our address. We may inspect the allegedly defective Product at its installation site. We have the sole right to determine whether a submitted Warranty claim is valid.
Exclusive Written Warranty and Remedy
These Warranties are the only express warranties The Cabinet Guy- QuikDrawers LLC provides for QuikCAB cabinetry Products. They state The Cabinet Guy- QuikDrawers LLC’s entire obligation and the Owner’s exclusive remedy for a breach of these Warranties. The Cabinet Guy- QuikDrawers LLC will not recognize any other warranty attributed to it or communicated by its agents, dealers, or distributors unless that warranty is contained in or authorized by this document.
Limits on Liability
The remedies described in this document are your sole and exclusive remedies and our entire liability for breach of an applicable Warranty. Under no circumstances will our liability exceed the actual amount you paid for the defective Product. We are not liable for consequential, incidental, special, or punitive damages or losses, whether direct or indirect.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Implied Warranties
To the extent permitted by applicable law, the duration and remedies of all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited to the duration and remedies of the applicable Warranty stated in this document. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
Governing Law and Forum
These Warranties are governed by and construed under Texas law, without regard to conflict-of-laws rules. Any legal action concerning these Warranties must be litigated in the courts of the State of Texas, and you agree to submit to the personal jurisdiction of those courts.
